Benefits for Referrer (person referring):
- Each person referring friends or family will get cashback on successful conversion of a project.
- Successful conversion of a project is defined as the completion of the ground floor slab.
- Cashback will be given within two weeks of successful conversion of a project.
- The maximum cashback per successful referral conversion is as follows:
- Project Value less than 30 Lakhs: INR 15,000
- Project Value 30 to 40 Lakhs: INR 20,000
- Project Value greater than 40 Lakhs: INR 25,000
- The discount amount for the new project shall be applied to the final milestone of the project.
- All payments will be made through direct account transfers only.
- An individual can refer any number of people in a year.
- The offer is valid only in cities where Ganya Constructions is operational.
- Ganya Constructions reserves the right to modify the offer without prior notice.
- Ganya Constructions reserves the right to interpret the offering in case of ambiguity.
- Multiple offers cannot be combined when seeking cashback or a discount.
- Rights to interpret ambiguities in the T&C shall lie exclusively with Ganya Constructions.
By using the Services, You agree that You have read, understood, and are bound by these Terms, and that You comply with the requirements listed herein. If You do not agree to all of these Terms or comply with the requirements herein, please do not access the Platform or use the Services.
Services
a) Ganya Constructions connects customers with service providers of all types (individually, a “SP”). We help customers discover and select a SP based on characteristics that matter most to them.
b) Ganya Constructions will act as an intermediary and assist the customer to get the project completed as per the agreement executed between the customer and an SP. Once the contract has been executed between the customer and the SP, and a copy is submitted to Ganya Constructions and the project has commenced, Ganya Constructions will provide services on tracking the phases and development of the project.
c) Building materials can be supplied to registered businesses (B2B) only.
d) Individual customers (B2C) or end consumers can’t purchase construction materials with Ganya Constructions’ Building Material Supply Team.
e) There are pre-specified timelines for the SCM team to execute a particular material category.
f) Invoices will be directly raised by Ganya Constructions to the business within 48 hours of delivery.
g) Ganya Constructions will share leads of customers enquiring for assistance in plot development to developers for a fixed commission fee. Ganya Constructions in no way will be involved in negotiating the price of the parcel of land being bought or discussed by the customer.
h) Ganya Constructions will digitally promote its client partners. This assistance will be for a fixed fee. Nowhere will Ganya Constructions be involved in negotiating the price of the property.
i) Package rates are subject to build-up area and the number of floors.
Accessing And Using Our Site And Services
Initiating Service: You agree that any information you provide in creating your account is complete and accurate, and you agree to keep it up to date. For example, we provide some notices by email to your account, and You agree to keep that email current and valid as a method for providing notices under these Terms.
Restrictions: You will not nor will you allow any third party to:
- Modify, copy, or otherwise reproduce the Services in whole or in part;
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code form or structure of the software used in the Services;
- Provide, lease, or lend the Services to any third party;
- Remove any proprietary notices or labels displayed on the Services;
- Modify or create a derivative work of any part of the Services;
- Use the Services for any unlawful purpose or contrary to these Terms.
- Ensure that Your users comply with these Terms;
- Use commercially reasonable efforts to prevent unauthorized access to or use of the Services;
- Use the Services only in accordance with the User Guide and applicable laws and government regulations.
- Confirm that you are a business compliant with applicable law and not an individual with respect to the supply of building material.
Charges: You agree that use of any SP’s Services will result in charges to you for the products or services provided by such SP (“SP Charges”) and that use of the Ganya Constructions Services will result in charges to you for the products or services provided by Ganya Constructions (“Ganya Constructions Charges”) (Ganya Constructions Charges and SP Charges, collectively, “Charges”). You will be informed of Charges before products or services are provided by Ganya Constructions or SPs, as applicable (including cancellation fees and terms, if any). You should confirm Charges each time you request products or services. Applicable tax will be added to all Charges where required by law.
Payment: Payments for charges are immediately due upon the provision/start of applicable products and services. Payments are final and non-refundable and at the discretion of Ganya Constructions. Ganya Constructions will merely facilitate your payment to SP. You acknowledge and agree that your purchases of services and products from any SP are transactions between you and that SP, and not with Ganya Constructions.
b) Ganya Constructions will act as an intermediary and assist the customer to get the project completed as per the agreement executed between the customer and an SP. Once the contract has been executed between the customer and the SP, and a copy is submitted to Ganya Constructions and the project has commenced, Ganya Constructions will provide services on tracking the phases and development of the project.
c) Building materials can be supplied to registered businesses (B2B) only.
d) Individual customers (B2C) or end consumers can’t purchase construction materials with Ganya Constructions’ Building Material Supply Team.
e) There are pre-specified timelines for the SCM team to execute a particular material category.
f) Invoices will be directly raised by Ganya Constructions to the business within 48 hours of delivery.
g) Ganya Constructions will share leads of customers enquiring for assistance in plot development to developers for a fixed commission fee. Ganya Constructions in no way will be involved in negotiating the price of the parcel of land being bought or discussed by the customer.
h) Ganya Constructions will digitally promote its client partners. This assistance will be for a fixed fee. Nowhere will Ganya Constructions be involved in negotiating the price of the property.
i) Package rates are subject to build-up area and the number of floors.
Provision Of Services
Technical Support: As part of our Services, we will make our standard technical support available to you. Ganya Constructions shall provide access to its business Platform to all its registered users (both the SPs and the End Customers) to facilitate the provision of Services from SP to End Customer and payment from End Customer to SP in accordance with the terms of the agreement between SP and End Customer. Ganya Constructions shall neither be considered as a principal or an agent of either the End Customer or User nor of any SP. Accordingly, Ganya Constructions shall not be held liable in any manner pursuant to or for any transaction taking place between the users of Ganya Constructions’ business platform.
Ganya Constructions, by providing such opportunities to the registered user of its Platform, strictly prohibits any User from uploading any illegal, defamatory, discriminatory, improper, indecent, or objectionable content or materials in any manner whatsoever for any reasons. Among other remedies, Ganya Constructions may delete the concerned User’s account immediately without any intimation to such a user should any such content or materials be uploaded from any user’s account.
Account Information
a) Ganya Constructions may upload information relating to transactions with customers, including the sale of goods or services, costs, amounts paid and payable, and details of goods and services, on the Platform (such information is referred to as “Transaction Information”). Transaction Information may be exchanged between SPs and customers through telephonic calls, text messages, WhatsApp, email, or other electronic mediums that would depend on the contact details of SPs and customers provided on the Platform.
b) At the time of creating or uploading the first Transaction Information with respect to a customer, Ganya Constructions shall inform such customer of its use of the Platform to record such Transaction Information and Transaction Information related to future transactions and seek such customer’s express consent in this regard and to:
(i) the creation of a profile of the customer on the Platform, which will require sharing such customer’s phone number and contact details with Us;
(ii) share such Transaction Information with Us and third parties to improve Our Services;
(iii) receive communications from Us regarding: (A) information relating to their transactions recorded on the Platform; (B) requests for payment; (C) information about Us and the Services; (D) promotional offers and services from Us and its third-party partners, and (E) any other matter in relation to the Services.
c) Should the customer fail to provide consent, or withdraw consent, the SP shall immediately cease to use the Services in relation to that customer.
Your Responsibilities
a) The User represents and warrants that all information that is provided through or in relation to the Services is complete, true, and correct on the date of agreeing to these Terms and shall continue to be complete, true, and correct while the User avails the Services. Should any information that the User provides change during the existence of these Terms, the User undertakes to immediately bring such change to Our notice. We do not accept any responsibility or liability for any loss or damage the User may suffer or incur if any information, documentation, material, or data provided to avail the Services is incorrect, incomplete, inaccurate, or misleading, or if the User fails to disclose any material fact.
b) The User shall be solely responsible for ensuring compliance with applicable laws and shall be solely liable for any liability that may arise due to a breach of its obligations in this regard.
c) The User shall extend all cooperation to Us in its defense of any proceedings that may be initiated against it due to a breach of the User’s obligations or covenants under these Terms.
d) While We use commercially reasonable efforts to provide Users with a daily backup of their Transaction Information, Users should regularly and independently save, backup, and archive such Transaction Information.
e) The User shall not use the Services in any manner except as expressly permitted in these Terms. Without limiting the generality of the preceding sentence, the User may not:
(i) Infringe either directly or indirectly any third-party proprietary rights, including but not limited to copyrights, patents, trademarks, or trade secrets concerning any of the material or data;
(ii) Copy or distribute any part of the Services in any medium or manner;
(iii) Alter or modify any part of the Services;
(iv) Use the Services for any unlawful purpose;
(v) Post or transmit any data that contains any viruses, Trojan horses, worms, or any other harmful programs;
(vi) Use the Services to transmit or post any material that is libelous, offensive, defamatory, harassing, vulgar, obscene, or otherwise objectionable;
(vii) Use the Services in any manner that could damage, disable, overburden, impair, or otherwise interfere with Our provision of the Services;
(viii) Use the Services to intimidate or harass any other people or entities;
(ix) Use any automated system, including, but not limited to, “robots,” “spiders,” and “offline readers” to access the Services; and
(x) Attempt to gain unauthorized access to any part of the Services.
b) At the time of creating or uploading the first Transaction Information with respect to a customer, Ganya Constructions shall inform such customer of its use of the Platform to record such Transaction Information and Transaction Information related to future transactions and seek such customer’s express consent in this regard and to:
(i) the creation of a profile of the customer on the Platform, which will require sharing such customer’s phone number and contact details with Us;
(ii) share such Transaction Information with Us and third parties to improve Our Services;
(iii) receive communications from Us regarding: (A) information relating to their transactions recorded on the Platform; (B) requests for payment; (C) information about Us and the Services; (D) promotional offers and services from Us and its third-party partners, and (E) any other matter in relation to the Services.
c) Should the customer fail to provide consent, or withdraw consent, the SP shall immediately cease to use the Services in relation to that customer.
Intellectual Property Rights
a) We own all the intellectual property rights relating to the Services, including all rights, titles, and interests in the platform, materials, and any modifications or improvements to such platform and materials, including any feedback that is shared by any of the users.
b) All content on the platform, including the Services, text, software, scripts, graphics, photos, sounds, music, videos, and interactive features, shall remain the sole property of Ganya Constructions, or its licensors. You agree to not engage in the use, copying, or distribution of any of the content other than as expressly permitted herein.
c) We reserve the right to terminate your access to the platform, without any advance notice, should you infringe these terms or any third-party rights.
Term And Termination
a) These Terms shall remain in effect unless terminated in accordance with the terms hereunder. We may terminate these Terms immediately upon written notice to you if you violate your obligations under these Terms.
b) Upon termination of these Terms:
(i) We will cease providing the Services, and You will immediately cease using the Services;
(ii) any amounts due to Us by You will become immediately payable; and
(iii) We may delete your archived data within 30 days.
Disclaimer Of Warranties & Liabilities
a) You expressly understand and agree that the use of the Services is at your sole risk. The Services are provided on an “as is” and “as available” basis. We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
b) We do not warrant that:
(i) The Services will meet your requirements;
(ii) The Services will be uninterrupted, timely, secure, or error-free;
(iii) The results that may be obtained from the use of the Services will be accurate or reliable;
(iv) The quality of any products, services, information, or other material obtained by You through the Services will meet your expectations.
Indemnity
You shall indemnify and hold Us harmless from and against any claims, actions, demands, liabilities, judgments, and settlements, including, without limitation, reasonable legal fees, costs, and expenses, arising in connection with any claim due to or arising out of Your use of the Services, or Your violation of these Terms, or the violation by You of any third-party rights.
b) We do not warrant that:
(i) The Services will meet your requirements;
(ii) The Services will be uninterrupted, timely, secure, or error-free;
(iii) The results that may be obtained from the use of the Services will be accurate or reliable;
(iv) The quality of any products, services, information, or other material obtained by You through the Services will meet your expectations.
Limitation Of Liability
In no event shall We be liable for any indirect, incidental, special, consequential, or exemplary damages, or damages for loss of profits, goodwill, use, data, or other intangible losses, whether based on contract, tort, negligence, strict liability, or otherwise, even if We have been advised of the possibility of such damages, arising out of or in connection with the Services.
Consent To Use Data
You agree that Ganya Constructions may, in accordance with its Privacy Policy, collect and use your information and technical data and related information.
Modification
We reserve the right to modify or discontinue the Services (or any part thereof) at any time, temporarily or permanently, with or without notice to You.
Compliance With Laws
You agree to comply with all applicable laws, statutes, ordinances, and regulations in connection with your use of the Services.
Jurisdiction & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, India.
Miscellaneous Provisions
a) Severability: If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
b) Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms at any time without notice to You.
c) Entire Agreement: These Terms constitute the entire agreement between You and Us and govern your use of the Services, superseding any prior agreements between You and Us.
d) No Waiver: Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

b) Upon termination of these Terms:
